Highlights Of Bills Replacing IPC, CrPC & Evidence Act As Stated By Home Minister In Lok Sabha

The Lok Sabha today passed three criminal law bills, The Bharatiya Nyaya (Second) Sanhita 2023, The Bharatiya Nagarik Suraksha (Second) Sanhita 2023 and The Bharatiya Sakshhya (Second) Bill 2023, which seek to repeal and replace he Indian Penal Code 1860, Code of Criminal Procedure 1973 and the Indian Evidence Act 1872.

Union Minister of Home Affairs Amit Shah, in his reply speech in the Lok Sabha today, mentioned certain highlights of these bills. They are :

Provisions relating to FIR, chargesheet, trial

The Home Minister also responded to concerns raised about the provision allowing police custody beyond the first fifteen days of arrest. Clarifying that the total police custody cannot exceed fifteen days, he said that the provision is introduced to allow flexibility, so that police can seek custody in different spells over 40 or 60 days as the case may be. This provision will also address situations where high-profile accused feign illness to get themselves admitted to hospitals during the first fifteen days to defeat police custody.
