The Supreme Court on Friday (October 17) stayed the arrest of Bihar-based contractor Rishu Shree by the Enforcement Directorate in a case under the Prevention of Money Laundering Act (PMLA).
A bench comprising Justice Surya Kant and Justice Joymalya Bagchi passed the interim order while refusing to entertain the writ petition filed by Rishu Shree against the ED. The bench asked the petitioner to approach the High Court for relief and stayed coercive actions by the ED till November 10.
Senior Advocate Mukul Rohatgi, appearing for the petitioner, submitted that the writ petition was filed since certain provisions of the PMLA were challenged.
According to the ED, Rishu Shree, who's firms work as contractors/subcontractors in various Bihar Government departments, such as Water Resources, Health, Public Health Engineering, Urban Development, Bihar Urban Infrastructure Development Corporation (BUIDCO), Education, Building and Construction, and Rural Works Department, is alleged to have a nexus with various Government officials to facilitate tenders for illicit personal gains.
In June this year, ED had conducted search operations at nine locations in Bihar in the case concerning Rishu Shree, and said that various incriminating documents were seized.
