Supreme Court Issues Notice On Plea To Include 'Haemophilia' Under Rights Of Persons With Disabilities Act

The Supreme Court today(November 10) issued notice in a writ petition filed by Haemophilia Federation of India, seeking either the inclusion of Haemophilia under Section 34 of the Rights of Persons with Disability Act, 2016 (RPwD Act) or striking down of Section 34 to the extent that it excludes Haemophilia for the purpose of reservation.

A bench comprising Justice Aravind Kumar and Justice NV Anjaria issued notice in this matter and sought a response from the Union Government.

As per Section 34 of the RPwD Act, it provides for 4% job reservation for specific disabilities. It is the contention of the petitioner that despite being a benchmark disability, it has been excluded for purpose of reservation.

It should be noted that the bench is also hearing another writ petition relating to the exclusion of persons with haemophilia from appearing for the Union Public Service Commission (UPSC) exams. During the hearing in September, Justice Kumar had asked what is the legislative wisdom for excluding blood disorder from the reservation.

Interestingly, some of the petitions challenging the exclusion of people with haemophilia is also pending in various High Courts.
