Plea Filed Before Supreme Court For Military Nursing Service Officers' Entitlement As 'Ex-Servicemen' Post Retirement

A writ petition has been filed before the Supreme Court seeking entitlement as "ex-servicemen" for military nursery service (MMS) officers post-retirement, along with all consequential benefits.

The matter was listed today before a bench of Justices Surya Kant and N Kotiswar Singh, which told Senior Advocate Dr Adish Aggarwala (for petitioners) that the case will be heard with another pending matter ie Union of India v. Maj. Gen (Mrs) Usha Sikdar.

Briefly put, the petitioners seek a declaration that they are part of the regular army for all intents and purposes under the Army Act, 1950 (and related regulations). Further, they demand grant of parity with regular commissioned officers of the Indian Armed Forces, both during and post-service.

The petitioners also seek quashing of any orders, policies, or practices of respondent-authorities that deny them "lawful entitlement" to ex-servicemen status and parity with regular commissioned officers of the Indian Army. In addition, it is prayed that the respondent-authorities not take retributive or punitive steps against them for filing the present case.

The petition is filed through AoR Amish Aggarwala.
