Supreme Court Orders Status Quo On Bale Shah Peer Dargah Demolition

The Supreme Court today (May 19) ordered status quo on the Maharashtra Government's demolition order against constructions at Bale Shah Peer Darga, Uttan.

The bench of CJI BR Gavai and Justice AG Masih was hearing a challenge to the order of the Bombay High Court, which refused to interfere in the demolition orders as it found that 'no urgency is made out'.

The bench granted stay of 4 weeks on the demolition orders. The following order was passed :

"List after four weeks. Dasti permitted. Serve to the standing counsel of Maharashtra. Till the next date, there shall be status quo."

Senior Advocate Vinay Navare, appearing for the Dargah Trust, informed the bench that Revenue Minister Chandrashekhar Bawankule has ordered the demolition of alleged illegal constructions at the Dargah complex before May 20.

Bawankule had made this statement while responding to a question raised by another legislator, Niranjan Davkhare in the legislative council's proceedings.

The Dargah Trust has been accused of encroaching on government areas that cover protected mangrove belts at Chowk Jetty, Uttan.

Advocates Mayank Pandey and Prashant Pandey also appeared for the petitioner.
