#A brief overview about Relevancy and Admissibility of facts


| RELEVANCY | ADMISSIBILITY | | Relevancy as the term expresses, it is the facts which seem to be relevant to the case or the issue based upon probability. | Admissibility refers to the function of the court; the court may dismiss a certain fact, or may be bound by the law to admit certain relevant facts. |

There can be many relevant facts in connection to the case. But not all the relevant facts are admitted or are admissible.Rule of admissibility, The court may admit certain facts from the pool of relevant facts and sometimes court is bound by the law to admit such facts in order to render justice.
Relevant facts are generally considered/found only by logical reasoning.Admissible facts are accepted only by the act of law.
Relevancy can be ascertained through logical relevance or legal relevance.However not all logically relevant facts can be admissible but all the facts legally relevant shall be admissible.
The court uses its discretionary power on the relevancy/ relevant facts.The court cannot use its discretionary power to accept admissible facts and it is mandate by the law to regard admissible facts.
The rule of relevancy is dealt from sec.5 – 55 of the Indian Evidence act.The rule of admissibility is dealt in sec.56 of the Indian evidence act.
